THE APPLICANT and any co-applicant (hereinafter called THE APPLICANT) who has applied for credit and signed above, hereby requests credit from WEST NOVA FUELS LIMITED, and/or WEST NOVA PROPANE (hereinafter called WEST NOVA) for the purchase of Petroleum Products. If WEST NOVA decides to extend such credit, THE APPLICANT agrees to the following:
Accuracy of Information
THE APPLICANT hereby certifies the above information to be true and complete. THE APPLICANT agrees to keep the provided information current, and advise WEST NOVA of any changes to the provided information.
Credit Report Consent
THE APPLICANT authorizes WEST NOVA to make investigations of THE APPLICANT credit standing from Consumer Reporting Agencies and from any of the references provided on this application. THE APPLICANT authorizes WEST NOVA to access THE APPLICANT credit report, whenever deemed necessary, while the account is open with WEST NOVA.
THE APPLICANT permits WEST NOVA to supply such credit information to other credit grantors and/or reporting agencies.
Account and Payment Agreement
WEST NOVA holds no obligation to grant credit to THE APPLICANT. WEST NOVA shall decide to grant credit to THE APPLICANT upon review of the completed credit application, and the credit information obtained. WEST NOVA reserves the right to limit or withdraw credit privileges or modify terms at any time at its discretion. THE APPLICANT is responsible for all credit granted from WEST NOVA.
All invoices are due within the agreed upon Net Terms of the account, not upon receipt of the account statement. Unless, THE APPLICANT is on a budget plan, in which an alternative agreement is executed. THE APPLICANT agrees to make payment within WEST NOVA credit terms. Past due amounts bear interest at the rate of 2% per month (26.84% per annum- compounded monthly). WEST NOVA reserves the right to alter the rate of interest payable on unpaid balances. WEST NOVA may accept payment arrangements; however, any arrangement does not alter this agreement in any way.
For any payment made by THE APPLICANT that is returned, including all pre-authorized payments via bank, pre-authorized payments via credit card, and cheques that are dishonored due to Non-Sufficient Funds, Stop Payments, and Account Closed, THE APPLICANT will be charged a $40 service charge per occurrence, which are subject to change, without notice.
WEST NOVA reserves the right to recover any costs associated with the collection and/or legal fees to collect unpaid debt from THE APPLICANT. THE APPLICANT agrees to pay a minimum collection fee of 20% of the unpaid balance, which are subject to change, without notice. The minimum collection fee will be added to the unpaid balance before collection and legal ramifications commence.
THE APPLICANT shall give notice to WEST NOVA of any changes of ownership, tenancy or intent to vacate the premises. Failing such notification, THE APPLICANT is responsible for payment of all invoices and deliveries to the property.
Delivery Agreement
THE APPLICANT agrees to purchase products and related services from WEST NOVA. THE APPLICANT agrees to use all products in a safe manner. THE APPLICANT agrees to pay for all delivered products and services rendered by WEST NOVA within the credit terms established. THE APPLICANT will pay for all deliveries at the posted price plus applicable taxes, in force at time and place of delivery. This price is subject to change without prior notice. If an invoice error occurs WEST NOVA will issue THE APPLICANT a corrected invoice. THE APPLICANT is responsible for remitting payment against the corrected invoice.
If THE APPLICANT requires delivery outside of established working hours OR requests a delivery below the established minimum volume then THE APPLICANT will be charged an additional delivery fee. The minimum volume and delivery fee are subject to change, without notice.
WEST NOVA will supply THE APPLICANT fuel requirements and related services until such time as one of the parties shall give the other notice of termination. THE APPLICANT authorizes WEST NOVA to enter the property for delivery and service purposes. WEST NOVA reserves the right to decline delivery to any property that does not meet current industry standards.
WEST NOVA will not be responsible for failure to make deliveries due to any causes beyond its control. WEST NOVA may, without being obliged to do so, prorate its available quantities of products amongst its customers.
THE APPLICANT shall not hold WEST NOVA responsible for any damage resulting from any inadequate reserve level of fuel oil, if delivery address remains unoccupied by an individual for any more than 48 hours; or if, for any reason whatsoever, consumption is unusually high; or if, for any reason beyond WEST NOVA’S control, they are prevented or delayed in making the heating oil deliveries. THE APPLICANT understands that an automatic delivery schedule is not a delivery guarantee.
Notice
WEST NOVA reserves the right to alter the terms and conditions of this agreement. THE APPLICANT may contact WEST NOVA by mail at West Nova Fuels Limited, PO Box 880, 73 Falkland Street, Lunenburg, Nova Scotia, B0J2C0; telephone 1-800-561-3835; fax 1-902-634-4409. Any correspondence made by WEST NOVA to THE APPLICANT is deemed to be delivered on the postmark date or date and time of electronic correspondence.
